1. Scope & contracting party

These terms apply to the use of the application "Ovulyx" (app and web app). The contracting party is Stefan Renzler, Donaueschingenstraße 28/45-46, 1200 Vienna, tax number 07 443/6544 (see Legal Notice). An account may only be created by someone at least 16 years of age — confirmed via its own checkbox at registration; no further age verification takes place.

2. Description of services

Ovulyx enables recording cycle, mood, and symptom data, as well as voluntarily and self-determinedly sharing selected information with a person invited by the user. Ovulyx is not a medical device, not a method of contraception, and does not replace medical advice.

3. Trial period & prices

Every newly created account receives a 30-day free trial with full functionality. After that, continued use is subject to a fee:

Purchases in the web app: All prices shown are final prices. Under the Austrian small-business exemption (§ 6 para. 1 no. 27 UStG), no VAT is charged or itemized. Payment is processed via Stripe.

Purchases in the app via Google Play or the App Store: Purchase and payment are handled by Google or Apple under their terms. The final prices shown there apply; they include any VAT, which Google or Apple remit, and may vary by country. The 3-year plan is only available in the web app. Extra connections are offered monthly in the app.

4. Contract term & cancellation

Subscriptions automatically renew for the booked period unless cancelled beforehand. A subscription purchased in the web app can be cancelled at any time, effective at the end of the current period, via the customer portal (in the app under "Settings → Account → Manage subscription") or by permanently deleting the account. Amounts already paid are not refunded on a pro-rata basis upon cancellation, unless otherwise required by law.

A subscription purchased via Google Play or the App Store is cancelled in that store's subscription settings, likewise effective at the end of the current period. Deleting your Ovulyx account does not cancel such a subscription; please cancel it in the store before deleting your account.

5. User obligations

• Provide truthful information during registration.
• Keep login credentials confidential; notify Ovulyx immediately of any suspected misuse.
• Only enable the sharing feature for people who have given their consent.

6. Limitation of liability

Forecasts and analyses in Ovulyx are based on statistical methods and the user's own entries. No liability is assumed for the accuracy or medical reliability of these forecasts. Ovulyx is not liable for damages arising from using the app as a substitute for medical advice. Beyond that, Ovulyx is only liable for intent and gross negligence, to the extent permitted by law.

Right of withdrawal

Consumers have the right to withdraw from a concluded subscription contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded (i.e. from the start of the paid subscription after the free trial period). To exercise your right of withdrawal, you must inform us (Stefan Renzler, stubensport@gmail.com) of your decision by means of a clear statement (e.g. by email).

Early expiry: Your right of withdrawal expires early if Ovulyx has fully performed the contractual service after you have expressly agreed that performance should begin before the withdrawal period ends, and you have confirmed your knowledge that you thereby lose your right of withdrawal. Since app usage continues immediately upon payment, this consent is obtained at checkout.

Consequences of withdrawal

In the event of an effective withdrawal, we will refund all payments received from you without undue delay, and at the latest within fourteen days of receiving your withdrawal notice, using the same means of payment you used for the original transaction.

Purchases via Google Play or the App Store: For a subscription purchased in the app via Google Play or the App Store, payment is handled by Google or Apple. You request withdrawal and refunds there under their terms (e.g. via your Google Play order history or Apple's "Report a Problem"), as we have no access to these payments.
